An interesting recent article in The Lawyers Weekly by Eric Knutsen entitled, “Auto Insurance as a Social Contract.” Mr. Knutsen begins his article as follows:
Automobile insurance in Canada is a product with a decidedly public purpose. It is a driver-funded source of compensation for motor vehicle accident victims – one of the important foundations of Canada’s social safety network.
Provincial governments are heavily involved in the regulation and operation of the automobile insurance regime in the interest of the public.… Continue Reading

If you hurt someone unintentionally or cause damage or loss as a result of your unintentional actions, then hopefully you have homeowner’s insurance to protect you and respond to a lawsuit on your behalf.
Homeowner’s insurance is very important insurance and, in our view, no one should be without homeowner’s insurance.
The importance of homeowner’s insurance is that it potentially provides you with a legal defence (in a lawsuit) and may cover you for any unintentional negligent acts which end up hurting someone or causing them loss or damage. … Continue Reading
Suing the Fire Department for Their Poor Handling of Your Fire
On behalf of Bougadis Law Professional Corporation posted in homeowner's insurance, insurance law, municipality on
Years ago I was involved in a file against the Toronto Fire Department arising from a house fire in Toronto, around the time of amalgamation of the City of Toronto. The house fire was in a nice residential area and suffered extensive fire damage, such that it had to be torn down and built new.
Part of the problem was the delay in the response of the Toronto Fire Department in arriving at the scene. Given that this fire occurred just past midnight during the week, many neighbours came out to watch the fire slowly consume the home and there were many witnesses who complained of the slow response.… Continue Reading

As widely reported (see yesterday’s Toronto Star article here), the 2007 sporting death of 15 year old Toronto high school rugby player Manny Castillo led to the criminal sentencing yesterday of the assailant (then 16 years old). The 16 year old who tangled with Mr. Castillo was initially charged criminally with aggravated assault and then later charged with manslaughter. He received a probationary sentence and other conditions but will not face jail time.… Continue Reading

As reported in the Ontario Reports, the 2009 Superior Court of Justice case of Glassford v. TD Home and Auto Insurance Co. (2009), 94 O.R. (3d) 630 (S.C.) deals with the duty to defend and the role of a homeowner’s insurance policy when you are sued in a lawsuit.
What happens if you get into a physical fight with your neighbour? And your neighbour sues you for hurting him in that fight?
If you have homeowner’s insurance, then your insurance company may have a duty to defend you in that lawsuit – i.e.… Continue Reading
Ex-Nortel CEO Fights his Insurer > Pay My Lawyer’s Fees!

A rather frequent issue is whether an insurance policy will apply to a lawsuit brought against the insured. That is, insurance premiums were paid at some point in time and now a lawsuit is brought against the insured and the question often is whether the insurance policy is required to “defend” the insured and/or provide “coverage” to the insured.
If the insurance company limits the scope of the policy’s response to the lawsuit, then the insured may choose to go to Court to determine how involved the insurance policy must become in relation to the outstanding lawsuit.… Continue Reading
